This has been an ongoing issue since December 2008 when he moved in. It stems from a water drainage. My neighbor alleges that it's my fault that his basement leaks. Since then he has been doing all sorts of things to make my life a living hell. I must have called at least 100 times since this situation started. Most recently he has been playing his radio so it could be heard by me. I know you guys have given him tickets in the past but that hasn't been working. One time I spoke to P/STG (He names the WPS Officer) who caught him playing his music loud to cause a disturbance and to make my life miserable.

***The rest of the nut's statement gets even crazier like he is asked what time it was that "HE" was playing loud music and the nut says it's 9:30 pm and the WPS statement has a time as the nut statement being obtained as 10:19 Pm and nowhere's do the WPS Officers claim to have heard the same noise in their narrative or other and they immediately entered in an investigation of mischief enjoyment of property against me as a result of the numerous number of dealings with myself and the WPS...So they started collecting the nuts statement...

a) Nut's opening statement about moving in in Dec 2008...My wife and I purchased and move in in May 2008...

b)Pay close attention to the word "He" move in...There has always been 2 people living in this house...My wife and I...So why is the "Target Only Me"...

c) The P/STG is the same WPS Officer who was present on Sept 22nd, and immediately requested a warrant be issue for my arrest on Mischief enjoyment of property charges on November 17th right after the first 2 WPS Officers collected the statement from the nut...and...more later...and...

d)As soon as I can subpoena for the 311 or 911 records it should show that he started calling on July 09, 2008 and I have further evidence that will establish that etc...

And I am trying to learn how to properly subpoena at the moment and haven't found out yet how and mainly the correct addresses to send the WPS ones or the 311/911 yet etc...and my next court appearance is on Mar 04th...

And I need all the legal help I can get at the moment Rosencrentz because I have been mainly fighting this on my own for the most part and without a lawyer yet because of a retainer money issue and I don't know how to use the Sandbox email yet and I have been having an issue with my fax machine not properly working as of late...so here is my email address...Thanks Rosencrentz...GGF

None specific other than the following which is about noise...

I gave you his opening paragraph earlier...and then that follows with a question about whether he knows his neighbor and where he lives...and the next question after that is...

What does he do to make your quality of life poor?

His answer...Plays loud music at all hours of the night. He plays loud base and he has been doing this for a while.


The next question asked is...Have you tried to solve the situation yourself?

His answer...At first before this situation got out of hand, I asked him to stop playing his music so loud and his exact words were "If you don't f--- like it call the cops". Since then I have been calling you guys...

And the next question is...Today what time was he playing loud music at?

His answer...At about 9:30 pm.

Next question is...Now that you have read your statement, is there anything you want to add, delete or change?

His answer...I just want to say that the quality of my life has changed and I can't do some of the things that I did before he moved in. I can't sit outside, I can barely get a good nights rest because of his actions. He continues to play loud music and annoy me. It has to stop. That's it.

End of the nuts statement used to incarcerated me on Nov 27th...

And none the less...He is on public records as starting to make noise complaints phone calls on July 09, 2009 and this is a known fact because of a Nov 11th WPS visit...and...

And he is also on record as having made the phone call(s) to the 311 number and complained about my ditch etc and I believe it was on July 09, 2009 (not recorded note by me) and the inspector came out on July 13th (this is a recorded note by me)...and I know some of this stuff already because I took notes on sticky pads etc...and mainly after Sept 22nd I began taking notes of every phone call I made or received and the date and time and or the subject matter etc...and there's going to be some with a lot of egg on their face someday...and because I also wrote 3 letters and also released them to "all" the powers that be in Oct etc...

And the lot grade dispute blew up and started July 04th, and I built the little ditch July 06th which he never expected me to do and which all the city inspectors that have come out have said to me that it is the best thing you could have done at this point in time and more or that later because I have to go now...GGF

Just wondering how wise it is to put so much detail about this in a public forum. There's a lot of people who read this, perhaps some members of the WPS and people who live on Kilbride. Might not sit well to refer to the complainant as being "nuts."

Freeman here are a few facts...

a)He refused to comment or talk to the reporter other than the short statement he did and was printed...

b)He has called on other neighbors about other things...

c)He has complained so often about the mailman that we were the only neighborhood in Wpg getting our mail delivered on weekends when I first moved in because the mailman use to scramble the delivery and the entire neighborhood use to walk around and we use to put each others mail in the correct mail boxes etc...

d)He has made countless phone calls and complained to the city about the garbage truck not placing the bin in it's exact location as per what he felt was the exact location the garbage bins are suppose to be...

e)If you think my neighbors are happy about what they have witnessed done to me and my wife...The entire neighborhood is outraged along with everyone that knows me or my wife personally...

f)As far as him being called a nut by me either publicly or privately...LET THE BASTARD COME AND GET ME ALREADY because he is a nut...and...

And the irony to all this is that I actually have a "lawsuit" and "other criminal charges" I can lay against him as soon as I deal with my mischief enjoyment of property charges...and...

And if you think I don't have more than enough evidence to prove my case against him including both still and camcorder pictures of all the changes that occurred on our property since we purchased it back in May 2008 along with all the changes the neighbor made to his property and to further "Harass Us" instead of dealing with his lot grade issue since the dispute started on July 04, 2009...

Well Freeman I have so many pictures at this moment you and I could spend an entire day going through them...and...

And Freeman...You need evidence in a court of law to win a case and that includes the WPS who have nothing but a nutcase as their star witness...and...

And as a result of the WPS not dealing with the nut and charging him in the beginning with mischief regardless of how often we asked the WPS to do so and instead the WPS continuing to come by and "Harass US Instead"...and...

And also escalate a dispute and make a dispute what it is today...and...

And also what a handful of WPS who did what they did to me personally etc...and...

And the WPS have their own as witnesses against the WPS so I really don't know why the WPS did what they did and all I am asking is WHY?...and...

And last but not least Freeman...I won't stop until I know the answer to WHY the WPS did what they did?...and...

And because I am also a taxpayer in the city of WPG and a voter...and...

And 30+ WPS visits etc...and...

And a WPS Service that continues to want and or need more resources etc...and...

And what happened to me and my wife can happened to anyone in WPG including yourself Freeman...and...

And I have evidence that it has happened to another individual and or neighborhood in Wpg...and...

And that is/are the reason(s) I will not stop until I know the answer to WHY did the WPS and the city do what they did...and...

Might be his blaming them and making them the scapegoat for his problem , suggest you turn it down a notch or two . Or frigging move .

I can't figure this out. I asked what the specific allegations were behind the criminal charge, but no answer. I can agree that the cops act like buffoons on a regular basis, but to process a criminal charge without any basis sounds really off the wall. And then to take someone into custody based on a relatively minor charge doesn't make sense to me either. Usually, someone is only taken into custody if they present a danger to themselves or others, or at risk of fleeing or it is reasonable that they will continue to do what they are charged with. There has to be more to this story. As the saying goes, 3 sides to every story.

How about ....the cops are frigg'n idiots that have laid charges just to stop the dealings between these guys and pass the responsibility for the matter on to others.

They don't care is the guy is guilty or innocent...they have finished with the matter.

And 3 sets of WPS visits the Labor Day Long weekend...and...

And at any rate I wrote the letter and took the time to drop it off at the District 3 and got an incident# and so on and the letter simply warns the WPS that we had a nut on our hands and that this could become much uglier which it did etc...I warned the WPS that this was a lot grade dispute in writing and to stay out of it by continuing to respond to his ridiculous false allegations of noise etc...I warned the WPS back on Sept 08 that this nut was out to get me and I can without a doubt prove that...and...

And now further begs the question of Why did the WPS do what they did?...and...more later...GGF

That could be, but then why wouldn't the Crown dismiss the charge before it went any farther. Surely someone in the Crown Prosecutor's office has reviewed the file (OK, hopefully someone has reviewed the file) and determined that theres insufficient background to prosecute....if that were the case.

Just because you wrote a letter doesn't mean that the police shouldn't respond to complaints by others.

OK fair enough except for the following...There are no other neighbors that complained except the nut and I can prove that...and...

And I already knew the September 02 summons was bogus simply because of the manner it was written at the time plus the time and date on the ticket I can prove nobody was home etc and this of course was back at the beginning of Sept and with the first ticket/summons...and...

And look Freeman...I was told/advised in December I should have gotten a "Piece Bond" put against the nut neighbor back in the beginning which didn't even occur to me at the time and under no circumstances did I ever think all would have gone this far already...and...

And if you want to know why I don't have a piece bond against the nut now...I'll tell you what I told some of the lawyers and they agree...It's because I will put the nut in jail already and I don't want anything in my way when I do so...and...

And the way this can easily be done...29 plus sets of WPS Officers that came by and visited and nothing was going on etc...and...

And of course first things first...and the question is always WHY?...Why didn't the WPS charge him with mischief instead of me and why did they not do it back in Sept already...and...

Freeman mediation was only offered to me in December when I made my first appearance on my mischief enjoyment of property charges...and...

Uhhh, GGF, by virtue of yourself writing a letter to the cops warning them of possible escalation may have set the stage for them to perhaps consider YOU as a potential problem? Silence is a virtue never to be underestimated.

For whatever reason that you were arrested, you have to plead not guilty, and request all the information from the Crown regarding the charges.
If you are in court to plead, you do not plead until the Crown has given you all the information that you require. give them a list that you need, all phone complaints, against you, and all other neighbours, and all complaints that this neighbour has made to the city, to the post office, etc.
It might be evident that the nutcase isn't you, but him, if there is a record of other complaints. This saturday delivery from the post office could show that he complains about everything to everyone!
You have to get this mischief charge thrown out, and then you can file a charge of unlawful arrest, and you can expect to possibly collect up to $5500, but you have to be not guilty to proceed on the unlawful arrest allegation.
I got +$1000 for 4 hours of being detained.
Your case, if you are found not guilty may be similar to Carpenter v. McDonald (1978) in Ontario, where the plaintiff was arrested and detained by the police. The court found that the police had used their criminal law powers to bring an immediate resolution in favour of one party to a civil dispute. The police threatened the plaintiff with arrest, imprisonment and prosecution, and in fact did those acts. The court held that the police had acted with undue haste and without proper consideration of the facts. The plaintiff was awarded $5500.
The above information was taken from a letter from Manitoba Justice, back in 1997 after I was arrested for being unlawfully at large. This was because my wife and kids were tired of me smoking Honduran , hand rolled cigars and drinking Crown Royal in my gazeebo. lol

Were you "doing work" into the wee hours of the night perhaps?

BTW I do not think it is a good idea to air your grievances here especially in such a fractured form. You need to sit down, if you have not already done so, and CHRONOLOGICALLY detail everything in a DISPASSIONATE form of prose. Using words like "the nut" is not going to gain you any sympathy. If all you say is true I do see a strong LERA case but having gone through that process I can tell you right now that if you think this situation is tough just wait. You will have to have the patience of a saint.

The burden of proof will be on your shoulders so best for you to cool down and start writing. Having already gone to the media is not going to make it any easier for you either especially given that your court dates have not occurred as of yet.

Start saving for a good attorney. Cops who are being taken to task have at their disposal highly paid-for attorneys (courtesy of their Union) with last names like Weinstein.

I feel like this whole thing has become very circular in nature and my inner-cynic is being awakened. I have provided some solid advice based on experience. If you are honest and serious you should perhaps consider not only my advice but the timely advice of others here as well. AND, please stop going on and on and on and on???????
