yup.. one of these followed about 200 feet later by an actual radar van with say at a minimum 3feet by 3feet diaganol yellow /black striping on the back of it. indicating speed camera..

anyone ticketed at that point deserves a triple fine.

lol! The City said it spent the $11,000,000 already paying off Shindleman Realty- So that will end any money returning to those rich Winnipeg motorists!

I find it ridiculous that A councillor is demanding that the province consult the city before saying that tickets will be refunded or not. WHY o WHY would the province have to consult with the city over refunding illegally issues tickets?

someone should sue the province for not putting the city in jail for breaking the law and illegally handing out some of these tickets.

Let that councilor be the city's proxy and do their time...

As I have said they are as dishonest as they can be on this one, .

Just a thought... isn't the commissionaire monitoring the photo-radar technically a "worker"?

Deank

yup....brought that up before that technically him being there makes it all legal...

legal, but not right.

Not to be picky, but the commisionaire isn't doing construction work, so it's a stretch....one I very much doubt would hold any water in court.

Dont think the NDP and the city wont use that as an excuse during the pending legal battle

oo yeah there another smart thing eh? We dont want to lose money because it would cost us too much to review all the cases.

Well guess what asshats... it will cost you more for the pending legal battle, followed by doing the work. frick you are idiots.

This just in!!!!!!!!!!!!!! I guess it really doesn't matter if you think you didn't break the law, according to the law as it was then, you did! And because of the uproar all of those who paid their tickets and are now crying foul, the laws have been changed to better illustrate when, where and why the photo camera vehicles can be in construction zones.
http://www.winnipegsun.com/news/manitoba/2009/05/14/9453426-sun.html
And if you can't see a photo radar vehicle ahead of time then you are not paying attention. In order for these vehicles to get their pictures accurately they have to park alone in the designated zone (school &/or park), they can't be in the middle of a group of vehicles because the camera and sensor will not work accurately. So when you are coming up on one of those zones and you see a vehicle parked all by itself, 80% of the time it is a camera vehicle.

If anyone had a doubt as to their idiocity, this should remove it.

Are these traffic tickets not stored in a database? It would take 5 minutes (I'm being generous) to write a query to report the tickets that are within the times, speeds, and outcome criteria to reverse the tickets!

"This just in!!!!!!!!!!!!!! I guess it really doesn't matter if you think you didn't break the law, according to the law as it was then, you did! "

But for two reasons they were not breaking the law in alot of the cases.
1) And this one is totally bogus in my opinion... no ending sign..
2) A judge has ruled that tickets done when no workers present were in fact not legally issued.

I guess it would make too much sense to simply say "Look we admit that some of the tickets we issued were in fact illegal. If you feel you may have recieved an illegal ticket you have already paid for please call xxx-xxxx to request a copy of any photo radar tickets issued to you in the last 12 months. You may review your ticket, and if it falls under the criteria at ndpphotoradarstolemymoney. com, you may request a refund from the magistrate at 330 Broadway"

All they'd have to do is man a phone line, set up a website with guidelines of who MAY deserve a refund and be willing to reprint some tickets. Costs would be minimal and the onus would be on the drivers who recieved the illegal tickets to request reimbursement.

No need to go over 60,000 tickets to figure out who deserves a reimbursement.

Are they really that stupid that they can't figure this out?

Great idea grumpyrom, but that would be taking work away from union members......

Are they stupid? It appears that they are.

really good idea grumpyrom,

would it be too much to add a slight caveat? It costs you $5 to apply? If you are right you get the $5 back to.. if you are wrong..then the $5 cost helps defray the cost of setting up the line? You know make sure people actually think about applying before they apply?

FlyingRat

I think with that level of complication, you just added $10M to the cost of the operation, Deank! Smile

IMO if you are talking about stupid, then the stupid ones are the ones who paid the tickets. If they thought they were given out illegally then fight it. And don't whine "I don't have the time" because that is a crock. When it comes to your pocketbook and your fine is upwards of $250 + and you really thought it was worth the fight you would have fought it. By paying for the ticket you admit you were speeding! Again just my opinion.
I drive through many of these zones on a daily/weekly basis and always slow down, regardless of time of day and day of the week because I know the dangers that could be there because it is a construction zone. But people just don't get it, even if there are no workers there, a construction zone comes with hazards associated with it. But then I have a son who works in a similar type of industry so maybe I am a little more aware than most who are out for #1 only.

how about then..

its court costs added on to the appeal if your appeal fails... but the court costs are only $5?
