Or perhaps the judge is making it look like ample time was used for thining about it so that his ruling is not simply overturned on yet another appeal.

That's the problem with being a criminal lawyer - how do you build your business ? High profile cases. Unfortunately the high profile cases are also sometimes the most offensive.
That being said, and with the facts as they have been reported by the media, I think his argument that the child could have chosen to be in the basement given the testimony of the mother and the evidence of abuse is very weak. Judge should have tossed it.
I'm concerned that the judge reserving his decision means an increased possibility that the appeal might be successful.

I can see a lawyer taking the original case, escpecially through Legal Aid, but why take the appeal on bullshit grounds.
