Is this really a human rights case where she should have been given money? Or should it have just been a simple ruling that the landlord in questions policies should change? I can certainly understand why a landlord might want to only allow kids on the first floor.. dont agree with it.. but I can understand where they think they are doing good.

i could understand if this was a MH place...but if it's private property...there should be no grounds for a case here.

how many "seniors" centres have popped up all over the country...try to get in there when you're age 30. Seems like discrimination to me.

If it's a private apartment company...they are allowed to just say "it's our policy"...and the lady can't do anything about it.

If I was a tenant there, and I saw kids heading for a 2nd level (or higher if there are any) apartment...I'd complain...especially if I lived underneath them, as my rental contract would've assured me I wouldn't have to worry about kids living above me making noise.

If the real estate agent handling this is smart...they'll fight the ruling in actual court.

In her ruling, Harrison also wrote that the rule restricting families with children to the main floor of an apartment building is “based on impressionistic assumptions” and that there was no data showing that all children are likely to make noise.

She also found that the evidence did not support that safety was a motivating factor in adopting the main floor only rule.

Seems to me if they denied her an apartment based on noise and safety, the ruling was a good one.

Whatever the ruling is, the statement that "there was no data showing that all children are likely to make noise" is pretty naive. Children make noise, they're supposed to, except when they're sleeping

I have no doubt its wrong for the company to do that. However it aint no freakin human rights complaint.

The Human Rights Commission has been proven to be so bad in its rulings. Google Ezra Levant, and you will see how he handled a complaint against his magazine.
