Claims staff let her return to gaming after she asked to be banned

WINNIPEG -- A Winnipeg woman is suing Manitoba Lotteries Corp., claiming casino staff allowed her to continue gambling for years after she agreed to be banned from the establishments.

NO TROUBLE RETURNING

Georgina Bauer, a self-described "compulsive gambler," entered into the Voluntary Exclusion Program in April 1996 but had no trouble returning to the gaming tables just two weeks later, alleges a lawsuit filed last week.

"In spite of the program and her enrolment therein, she was thereafter continually allowed into the casinos operated by the defendant to gamble without any intervention, even though she was a regular and many of the card dealers and pit bosses she encountered knew her and called her by name," says the lawsuit.

Bauer alleges she wrote a letter to MLC in December 2000 reminding staff of her enrolment in the exclusion program, to no avail. She says she continued to gamble in city casinos, losing money at blackjack tables, "and never encountered any intervention by the defendant MLC."

The lotteries corporation had a duty to keep Bauer out of its casinos or advise her it would not enforce the exclusion program but did neither, the lawsuit says. "As a result ... (Bauer) has suffered serious financial and emotional damages," says the lawsuit.

The allegations have not been proven in court.

I was gobsmacked at reading this. Which arsehole lawyer actually took her case on this? How could she affard a lawyer if she pissed all her money away at the casino? Wasn't her exclusion "voluntary"?

What a complete lack of personal responsibility! Dumbass is right.

Not that I agree at all with her frivolous law suit, but why have an "exclusion" program if your not going to uphold it? Unless your only goal is to make it appear like your trying to help problem gamblers, but in reality you could care less. Lotteries would come out looking better in the long run if they dropped the "we care about gambling addicts" act and just admitted that they're pariah's like every other gambling establishment.

In the end she has no one to blame but herself. Weak minded people need to stay far far away from casino's to begin with.

Frivolous and without foundation. This case should not make it on the docket. Reminds me of the cases in the states of the fat teens suing Rotten Ronnies because of their obesity.....nobody shoved those fries and burgers down their throats.....when are people going to take responsibility for their own actions and seek help?

It would be so easy for people to get around the exclusionary elements. Not sure how it would work but a determined gambler should be able to do it don't ya think?

Don't be surprised if this goes to court and the fool wins; common
sense isn't always valid in a court of law, as has been
proven several times. Remember the lawsuite against MacDonald's and the
"hot" coffee?

Casino's monitor everything and everyone. I'm sure if they can keep out known cheats they can just as easily keep out anyone of their choosing. I know a few people who worked for lotteries and the problem gamblers are known by everyone, it wouldn't be tough to enforce the exclusion at all. The question is why would lotteries want to? I'd assume the problem gamblers generate a huge portion of their revenues.

All I'm saying is for them to drop the caring act, and publicly acknowledge that they are their to rape as many dollars out of patron's pockets as possible. It doesn't change the fact that this claimant is an idiot.

Perhaps, jsut perhaps, we should wait to hear more details on this. So far, this is only one side of the story. And, citing the fact that its a litigation in process, MLC will not be able to make a public comment.

No organization in their right mind will make public comment on issues before the courts. Its just not a good idea. These issues are not settled by public opinion, but rather by a judge.

That happened in the United States. This is Canada. It won't happen.

there are two cases in Quebec court right now dealing with this exact thing.

Quebec laws are slightly different. While most of these types of cases in Canada never get to court, they are a nuisance and are intended to draw money. Sometimes its just easier and cheaper to pay someone to frick off then it is to actually defend the case.
