Thats what the jury will have to determine in their sentencing. While a conviction of Manslaughter can be found even if there was no intent, the sentence will certainly indicate how they interpreted the facts.

True, the Judge will determine the sentence, which has always shown to be the best way to do these things.

My god how did newborns ever survive before respite care (sarcasm).....
Total BS...throw her in a cell with a noose in the corner and the knowledge she'll only be coming out of that cell one way. No f'ing way in hell do I sympathize with anyone who would intentionally abuse a newborn in that manner.
