this law sounds good... but...
http://www.winnipegfreepress.com/breakingnews/Province-mandatory-report-child-pornography-43046852.html

considering you can do a search on blue jeans on google and end up at a site that could be viewed as child porn, I see this as really opening up the gates for a literal ton of "legal" illegal searches of homes and computers.
How? Cops simply monitor your accessing the internet, note when you run into a potential illegal picture. and see if you report it..

No reporting and BAMO! warrant to search your home and computer because you broke the law. Hell I can see them sending some fake spam out that includes a potential illegal picture... and even if you delete it, they nail you for not reporting it.

Slippery slope here

The scary thing for me is where the line is drawn. They could theoretically bait someone with a photo of a 17 year old child, but how would someone know they're underage? If they don't report that, what happens?

As for this statement, "Cops simply monitor your accessing the internet, note when you run into a potential illegal picture. and see if you report it" I don't even think that is ethical! If there's an illegal photo online, aren't they obligated to have it removed?

how can the Manitoba Police remove a photo hosted on a server in singapore with a website registered in russia?

aint gonna happen. but much like the busts in the states where they get a 21 year old actor to pretend to be a 14 year old girl... as long as you think the picture you accidently accessed was child porn.. you could be charged for not reporting it.

heck is shakugan no shana child porn?

First...it would be yet another unenforceable law. What would be the point of reporting it, if it can't be prosecuted anyway?

Hell, if I reported every illegal thing I saw happen (on the internet or otherwise)...most the people I interact with would've been arrested (and of course released) several times over.

Just posting some of the photos and videos in this forum COULD be considered illegal (copyright violations).

And...it's also yet ANOTHER law that already exists. One called "obstruction of justice"...where failure to information related to a crime when asked can be charged with obstruction. But, it currently is only enforced if a crime is known to have been committed, and you are known to have knowledge of it.

Hopefully...someone will finally wake up wherever they are trying to make these stoopid laws...and we'll find something more useful for these idiots to do...like fill the potholes around the city.

actually besides this.. (and child abuse) the only illegal activity you can be charged for not reporting is treason. All other crimes..you dont have to report. All other crimes.. if asked by police you must give truthful answers or be charged with obstruction.

More NDP smoke and mirrors. Make it look like you're going after the problem by creating some bullshit anciliary law, rather than getting tough on the real offenders. They must have learned the lesson from the Chretien Liberals in creating offenders from law abiding gun owners rather than just getting tough on the assholes who commit crimes using a firearm.

hrmm.. tick you are going to have to do better then that. Based on the Child and Family services act what you posted does not constitute child porn

child pornography" means

(i) that shows a child engaged in, or depicted as engaged in, explicit sexual activity, or

(ii) the dominant characteristic of which is the depiction, for a sexual purpose, of a sexual organ of a child or the anal region of a child,

(b) any written material, visual representation or audio recording that advocates or counsels sexual activity with a child that would be an offence under the Criminal Code (Canada),

(c) any written material whose dominant characteristic is the description, for a sexual purpose, of sexual activity with a child that would be an offence under the Criminal Code (Canada), or

(d) any audio recording that has as its dominant characteristic the description, presentation or representation, for a sexual purpose, of sexual activity with a child that would be an offence under the Criminal Code (Canada); (« pornographie juvénile »)

from the act itself

"child" means a person under the age of majority;"

so any person under 18.. but the act fails to stipulate what a person is

do to this law and my son supposedly "accidently" clicking on an advertisement link.. yeah yeah whatever son... I have had to report a webpage and potentially will now have my privacy invaded, my computer and house searched and perhaps even my son or other members of my family arrested.

Does that sound right? IS that what the law is supposed to do?
