Personally, I don't get the controversy.

The owners own the restaurant...they have standards they want met...too bad for her if she doesn't meet them.

If your business has an "image", you don't hire outside the image...it's bad for business.

Would the Rockettes hire a man? Would you hire a female Santa Claus?

This is no different. She doesn't fit their "image"...so too bad. If she REALLY wants to work there, she'd change. The same as someone who wants to be a doctor, lawyer, teacher would go to school to obtain the skills required.

She is saying they wont hire her because she is Peurto Rican... that would be discrimination. They say they wont hire her, because she can not speak english to their standards, that is not discrimination.
A better question might be,,,does she reasonably expect to make $500 per day at that job.. and... ( from a different source....why is she no longer employed at hooters?? )

Her situation is no different than the hiring policies here in Winnipeg at Earl's and Joey's. They have set a corporate image and maintain that image by hiring a certain look of people. Same goes at Hooter's. I myself do not always agree with this policy but I understand it from a business point of view. As for the language issue this restaurant is in the heart of the tourist area of NY, Times Square so with all of the people who would be coming to this place, I as an owner would definitely want someone with exceptional proper English skills serving those who do not speak English as a first language so being able to understand your server is utmost. It is all about image, visual as well as social.

Here's a thought...send in a 300lb woman for the same job who speaks perfect English. Will she get the job?

Nope...why? because the owner doesn't want to hire her...it's a matter of appearances.

On that same note...send a 400lb guy to work on a high-rise steel construction site. Would a construction company hire him? No...for many reasons (first of which would be safety issues)...but because he's not right for THAT job. Find a different one.

Obviously she can find a job...just because she can't find THE job she wants is her problem...she's not qualified...plain and simple. Whether it's her skin colour, speech patterns, hair colour, freckle on her chin...it really doesn't matter....she's not the one for THAT job.

How am I discriminated against? The same as many of you I'm sure.

1) I'm a big guy...I go to a theatre or concert or sporting event...and I have to squeeze into those tiny stupid little chairs. The people who build these things discriminate against big people (so do airplane & bus manufacturers)
2) I'm "white"...can I go get a Native card so I don't have to pay taxes anymore? Can I get special loans or grants for school/business?
3) I'm male...same problems for loans & grants...but add clothing expectations, and hairstyles
4) I work...and because I work, I don't qualify for government handouts and free food or shelter...I have to pay for it all and live "week-to-week".
5) I don't have a college degree...so there are jobs out there I can't even apply for...even though I'd probably do them better than someone with one.
6) I'm in my mid-30's...so I don't qualify for old age pensions, and I'm too old to go to dance clubs without being treated like a sleeze.

Yes...these are discriminations, and yet...my life goes on without filing protests or lawsuits.
