I hit a jogger last night on Wellington Crescent

So, who is to blame?
There is a jogging trail on the left side and a sidewalk on the right hand side.
It was dark outside and the lighting in that area is non - existant!
And the brilliant I hit a jogger last night on Wellington Crescent 970993 guy was wearing all dark clothing, except where the blood was!
So who gets blamed? The 65 year old driver? Or the dumb ass jogger?
Why do joggers insist on using the road when there are safer places to jog? There is a jogging track, with a beautiful view of the Assiniboine River!
I have been challenged on Sundays by aggressive joggers to get off my street!

Rosen, my advice would be to hit a few more. Eventually, you'll get rid of the slower, weaker, sicker, and dumber ones... and the remaining ones will learn to use the jogging paths!

Leave the bodies on the street. That would serve to discourage others.

Or set up a unch of roadside memorials in front of your house.

Unless he darted out in front of you from behind some bushes.....you are 100% at fault. As the operator of the vehicle it's your responsibility to give right of way to pedestrians. I too drive daily down Wellington Cr. after dark (have for the last 10 years or so), and see a variety of joggers, cyclists, dog walkers etc. both on the sidewalk, on the trail down the middle and on the road. I don't see how you can put blame on a jogger running along side the curb unless they did something really stupid like dart into traffic without looking behind him.

I'd suggest maybe you should check and see if your headlights are aimed properly if the only reason you didn't see him is cause of the lack of streetlights and his dark clothing.

Rosie was the jogger on the road (close to the curb) running toward you? I was always taught that if you had to be on the road as a pedestrian that you were to walk facing traffic so that any vehicles could see you and you could see the oncoming traffic (and I also thought that was the law????). The pedestrian would also not be on the same side as the traffic going the same way, preventing being hit from a car coming from behind.
If this is still the law you might have something to fight against.

My car was making a right turn onto Wellington Crescent, and this pedestrian was standing on the street with his dark back to my car! he was invisible!
Furthermore the CBC this morning had one of its announcers warning pedestrians to wear illuminated clothing when out at night. This person was on the road and did not have an illuminated license plate from his rear end!
There has to be plenty of blame there!

Some peeps and cyclists may not be aware just how hard they are to see under certain lighting conditions. Many a time did someone just "appear" in front of me. If you wear dark clothing at night you best be absolutely certain EVERYONE can see you.

Some may say it is always the drivers fault unless someone jumps right in front of you. I don't buy that. Pedestrians and cyclists in the shadows, wearing dark clothing, can be almost invisible.
