Yikes! Dauphin dude is an idiot. I understand the police require a warrant to look through eMAIL and computers. Assuming that is correct, one would think a phone would be the same?

I think the border dude had no business looking through the phone. If it is legal, it shouldn't be.

Police yes, CBS no. Just recently they nailed a guy with child porn... how do you feel about him?


Its fairly obvious the CBS were searching his car simply because they did not think he was telling the truth about the price of his car. They were looking for any sort of receipt.

The guy blatantly lied to customs. He got caught, and that was reasonable grounds for the extra search. Simple solution to avoid situations like this? DON'T LIE TO CUSTOMS!

I want the police/CBS to catch all the bad guys, including terrorists and child-porn sickos. BUT... where do we draw the line? Should the police be able to walk into your home and search as they see fit because they want to? Should the police tap your phone simply because they want to?

Ummmm, huh?

It was reasonable grounds because he was caught? Kinda' convoluted logic me thinks. You need reasonable grounds BEFORE being searched IMO.

I agree (with you) GOM about the police and searches. However, I also believe that border guards should be able to look at everything....and I mean everything.

My point is that if he didn't blatantly lie to customs, maybe they wouldn't have conducted that search. He brought attention to himself, and yes there was merit to the search. Again, if you want to avoid confrontation, DON'T LIE TO CUSTOMS!

At first, I don't like the idea of having customs going through my computer or anything like that. But honestly, its no different than them going through a notebook, or your receipts. Its all data you collect.

I wonder how cheap he said he got his car for if the difference in his claim and the real price cost him $5000 in taxes and fees. Sounds pretty bone headed to me.

The guy is a pinhead.
He lied to customs officers about the purchase price of the vehicle. While he was inside the customs office a customs officer who was searching the car found his cell phone and read through the messages.
There are several ways this could have been prevented.
1. DONT LIE TO CUSTOMS OFFICIALS.
2. Password protect your cell phone or lock it.
3. Delete old txt messages, including the sent folder!
4. Dont leave your cell phone in your car.
5. DONT LIE TO CUSTOMS OFFICALS.
Simple. If you tell the truth, then you have nothing to worry about, unless you have been plotting terrorist or criminal activities.

I password protect my laptop and the border guards ask me to unlock it. I haven't asked what happens if I refuse to.

I bet they get to keep the laptop untill they can find the info they want to look at if you try and refuse or fail to provide the password. I wouldn't be surprised if they made you wait at the border for however long it takes them to crack it, or untill you give up and provide it to them.

I would not want to be stuck at the Border Services office while they took their time dealing with it. Better to just give up the info if you have nothing to hide. And if you are hiding something while crossing the border...well then your an idiot.

True. However at one point you are in fact simply put in the nearest Jail cell.

I think they searched the car because they were suspicious about the price he paid for the car, which raised some flags.

To claim it was simply because "they wanted to" is a gross simplification.

not really no. As long as the cops have reasonable belief that the vehicle is currently being used for a crime they can search.

"There was a strong odour of Marijuana" is used so often it aint even funny.
