Absolutely not. It's obvious that there was no malice intended, and the loss of a child is one of the most awful things that can happen to a human being. Worse than death, in my opinion. I say he has been through more than what is just.

1. His agony is already overwhelming, so as a moral punishment, prison is pointless. He'll learn nothing from prison that he hasn't learned already.

2. Others will not be stopped doing the same if the death of their child is not enough of a deterrent.

3. There is nothing to indicate that he's a threat to society or other children. If anything, he is much wiser now than many parents that haven't done the same.

I can't think of a single reason for putting him in jail so I say definitely no, he should not go to jail.

I say we need to be consistent in how we handle the inadvertent death of children.

I think that the knob that allowed his kids to freeze to death and the guy that shook his baby to death should get the same punishment. No matter how one slices these things children died. Punishment is mandated.

What we are dealing with now is degrees of punishment right? One month for one death? Two months for two deaths? An extra month because the dude was stinking drunk? An extra month because dude was angry?

How do we reconcile these things?

In this particular case, the child did not die. That would I think be a factor as well.

Yeah...but he didn't "accidentally" shake the baby, he violently reacted and the baby became a victim as a result.

There was reasonable cause for the kid to be removed from the parents by CFS before.

There's some reason the parents are not allowed to contact each other...is that from physical abuse from one or the other?

They guy should be put in jail, the mother should be investigated, and the kids (as bad as it sounds) should be put up for adoption.

Neither parent (it would seem from this article) is fit to raise children in a fit & nurturing environment. There's a big difference between raising kids in a limited environment filled with love, and a dangerous environment...no matter the conditions.

yeah odd that.. he gets the kids and the mother is the one that is not allowed to be contacted and the baby was siezed at birth.

Seems whomever decided it was time for the baby to be returned was not really looking closely enough at the situation.

How much time should he go to jail for?

personally...i don't think he should go to jail.

i think he should be given a handgun, with one bullet, and dropped in the middle of nowhere.

if he really feels that bad...he'll do the "honourable" thing.

An Arkansas father has been convicted of felony battery and sentenced to six years in prison for disciplining his young son by biting his toes.
Thirty-six-year-old Todd Wayne Hall, of Rogers, was also ordered Tuesday to pay a $10,000 fine.
The son, now 9, was 6 years old at the time. Prosecutors showed jurors photographs of his injured toes, which had bruises and cracks in the toenails. Hall also admitted in a court proceeding that he bit the boy's toes.
Hall was cited previously for biting his daughter.
Testimony revealed Hall and his wife, Virginia, would punish the children for blinking their eyes or moving while they were supposed to be napping.
The children are the custody of grandparents.
